1. Acceptance of These Terms
These Terms of Service (the “Terms”) govern your access to and use of the Westmoreland 7s website, registration forms, communications, and related online services (collectively, the “Services”). “Westmoreland 7s,” “we,” “us,” and “our” refer to Braden Braun.
By accessing the Services, submitting a registration, or participating in a Westmoreland 7s league, event, or activity, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services or register to participate.
2. Eligibility
Westmoreland 7s is an adult soccer league. Players must be at least 21 years old by the first scheduled game of the applicable season unless we expressly approve otherwise in writing. You must provide complete and accurate registration information and may not register another person without that person’s knowledge and authorization.
We may verify eligibility and refuse, suspend, or cancel a registration when information is incomplete, inaccurate, fraudulent, or inconsistent with league requirements.
3. Registration and Rosters
Registration is subject to space, roster availability, payment, and league approval. Submitting a form does not guarantee placement until we confirm your registration.
Players may register with an existing team or as individuals. Individual players may be assigned to teams based on available space, competitive balance, positional needs, or other reasonable league considerations. We cannot guarantee placement with a particular team, playing position, teammate, or amount of playing time.
Team captains are responsible for communicating league information to their players and helping ensure that roster members complete all required registrations, payments, acknowledgments, and waivers. Rosters generally contain 7 to 12 players unless Westmoreland 7s approves a different number.
4. Fees and Payment
All registration fees must be paid by the stated deadline using an accepted payment method. Prices, registration periods, and included benefits will be shown on the applicable registration page or season announcement.
You are responsible for ensuring that payment information is accurate and that you are authorized to use the selected payment method. Any third-party payment processor may impose additional terms and privacy practices.
5. Refunds, Cancellations, and Weather
Registration fees are generally nonrefundable after a player or team has been accepted, except when Westmoreland 7s cancels the entire season and expressly offers a refund.
Games may be delayed, shortened, rescheduled, relocated, or canceled because of weather, field conditions, park decisions, safety concerns, referee availability, emergencies, or circumstances beyond our reasonable control. Westmoreland 7s will make reasonable efforts to schedule makeup games, but makeup games are not guaranteed. Individual missed games, schedule changes, shortened games, forfeits, player withdrawals, injuries, and team removals generally do not qualify for refunds.
If an entire season is canceled, any refund amount may be reduced by nonrecoverable costs already incurred, to the extent permitted by law. Any season-specific refund terms presented during registration will control if they conflict with this section.
6. League Rules and Conduct
All players, captains, spectators, and guests must follow the published league rules, facility rules, referee decisions, and reasonable instructions from league staff.
Fighting, threats, abusive or discriminatory language, deliberate attempts to injure another person, harassment, intimidation, and other dangerous or disruptive conduct are prohibited. We may issue warnings, suspensions, removals, forfeits, or permanent bans based on the seriousness and circumstances of the conduct. No refund is owed when a person or team is removed or suspended for violating these Terms, league rules, or safety requirements.
7. Assumption of Risk and Separate Player Waiver
Soccer and related athletic activities involve inherent risks, including physical contact, falls, collisions, weather exposure, field conditions, equipment failure, serious injury, illness, disability, and death. Participation is voluntary.
Every player must complete any separate participation waiver, release of liability, medical authorization, or informed-consent document required by Westmoreland 7s before participating. These Terms do not replace that separate waiver. If a separate signed waiver conflicts with these Terms regarding participation risks or claims, the signed waiver will control to the extent permitted by law.
Participants are responsible for determining whether they are physically able to play and should consult a qualified medical professional when appropriate. Westmoreland 7s does not provide medical advice or guarantee that medical personnel will be present.
8. Schedules, Standings, and League Decisions
Schedules, field assignments, standings, playoff formats, and other league information may change. We will make reasonable efforts to communicate material changes through the website, email, text message, social media, Playpass, or another designated communication channel.
Westmoreland 7s may resolve questions involving eligibility, forfeits, scheduling, standings, rules, discipline, and competitive balance. League decisions are final unless we establish an appeal process for a particular matter.
9. Communications
By providing contact information, you agree that we may send operational communications about registration, schedules, weather, safety, roster placement, payments, and other league matters. If you separately consent to promotional email or text messages, you may unsubscribe using the instructions in the message. Consent to promotional messages is not a condition of purchase. Message and data rates may apply to text messages.
You are responsible for keeping your contact information current and for reviewing league communications.
10. Photographs and Media
Westmoreland 7s may photograph or record league games and events. Any use of a participant’s name, image, likeness, or voice for promotional purposes will be governed by the media-consent language presented during registration or in a separate release. 11. Website Content and Intellectual Property
The Westmoreland 7s name, logo, graphics, photographs, text, schedules, and other original website content are owned by or licensed to Westmoreland 7s and are protected by applicable intellectual-property laws. You may use the website for personal, noncommercial purposes only.
You may not copy, reproduce, modify, sell, distribute, scrape, republish, impersonate, or exploit our content or branding without written permission, except as allowed by law.
12. Prohibited Website Use
You may not use the Services to:
- Violate any law or another person’s rights;
- Submit false, misleading, fraudulent, or unauthorized information;
- Interfere with the website, security features, servers, or connected systems;
- Introduce malware, harmful code, automated scraping tools, or excessive requests;
- Attempt to gain unauthorized access to accounts, data, or systems; or
- Use league contact information for spam, harassment, or unauthorized marketing.
13. Third-Party Services and Links
The Services may link to or use third-party platforms, including Squarespace, Google, Playpass, payment processors, social-media platforms, and communication providers. We do not control third-party services and are not responsible for their availability, content, security, or privacy practices. Your use of those services may be governed by separate terms.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Westmoreland 7s does not guarantee that the website will be uninterrupted, error-free, secure, or completely accurate, or that any particular team placement, schedule, result, or playing experience will occur.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
15. Limitation of Liability
To the fullest extent permitted by law, Westmoreland 7s and its owners, organizers, staff, volunteers, contractors, sponsors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Services.
For claims arising solely from use of the website or registration Services, our total liability will not exceed the amount you paid directly to Westmoreland 7s for the applicable registration during the 12 months preceding the event giving rise to the claim. This section does not limit liability that cannot be limited under applicable law and does not replace or modify any separate participant waiver.
16. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Westmoreland 7s and its owners, organizers, staff, volunteers, contractors, and representatives from third-party claims, losses, or expenses arising from your unlawful conduct, violation of these Terms, infringement of another person’s rights, or misuse of the Services. This obligation does not apply to the extent a claim results from conduct for which indemnification cannot legally be required.
17. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any legal action relating to these Terms or the Services must be brought in a court of competent jurisdiction located in Westmoreland County, Pennsylvania, unless applicable law requires otherwise.
18. Changes to These Terms
We may update these Terms periodically. The revised version will be posted on this page with a new effective date. Material changes will apply prospectively unless the law permits otherwise. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
19. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our written permission. These Terms, the Privacy Policy, applicable season rules, and any separately signed registration documents or waivers form the agreement between you and Westmoreland 7s concerning the Services.
